Terms & Conditions

Please read these Terms and Conditions carefully before completing your application to register for this Coli-Shield Contribution Guarantee (“Contribution Guarantee”). They explain what the Contribution Guarantee covers, what it does not cover, the eligibility criteria and what we need from you to keep your contribution guarantee active.

1. About the Coli-Shield Contribution Guarantee

The Contribution Guarantee is a product benefit available to eligible customers who purchase a monthly subscription for an eligible Equine America product (these are detailed in Section 2 below) (“Subscription”). You can find our subscription terms and conditions here.

The Contribution Guarantee is not an insurance policy — it is a contribution guarantee offered by Equine America to eligible customers. The eligibility criteria are set out below.

The Contribution Guarantee covers any eligible horse which is successfully registered with us at the time of purchasing a Subscription (see our application form here). The customer must be the owner of the horse or have the legal right to register the horse, on the owner’s behalf when registering for the Contribution Guarantee.

The Contribution Guarantee applies to one eligible horse per Subscription only. Eligible Products are formulated and dosed for use by a single horse, and a separate Subscription is required for each additional horse.

The Contribution Guarantee becomes active 30 days after the date the registration is completed and accepted by us. Once active, the Contribution Guarantee will remain in force for the duration of the Subscription unless terminated earlier in accordance with these Terms and Conditions (“Subscription Period”). If as a result of a clinical manifestation of abdominal pain (“Colic”), a horse covered by the Contribution Guarantee , requires any invasive corrective or surgical procedure performed under general anaesthesia used in the treatment of acute abdominal pain of the equine stomach or large and/or small intestine and certified by the operating Veterinary Surgeon as an emergency to attempt to save the life of the horse (“Emergency Colic Surgery”) during the Subscription Period, Equine America will contribute up to £5,000 towards the cost of that surgery, subject to any existing insurance (see paragraph below) and these Terms and Conditions.

Where a customer holds existing insurance that may respond to the costs of Emergency Colic Surgery for their horse, a claim must first be made under that policy. The Contribution Guarantee will only apply once such insurance has been exhausted and will contribute to any remaining eligible costs up to a maximum of £5,000.

2. Eligible Products

The Contribution Guarantee is only available to customers who subscribe to one of the following products on a monthly subscription:

•     Coli-Uls-Gard Plus Pellets 9kg (per Horse)

•     Coli-Myco-Biome Plus Powder 3.6kg (per Horse)


(each an “Eligible Product”)

 

To benefit from the Contribution Guarantee a Subscription must remain active and uninterrupted at all times. If a Subscription lapses or is cancelled for any reason, cover under the Contribution Guarantee will end immediately for the horse registered for that Subscription.

3. Vet Code

A valid vet code is required to purchase Eligible Products on www.equine-america-vet.co.uk. If a customer does not have a vet code, Equine America will issue a temporary vet code to allow the customer to proceed. Our team will follow up to get the valid vet code signed up within 30 days. The customer must provide us with contact details of their veterinary practice without delay and authorise us to contact them directly. If we cannot obtain the valid vet code within the 30 days, then the Subscription can be terminated by us with immediate effect, and the customer will not be able to continue to purchase the Eligible Products.

4. Horse Eligibility

To be eligible for the Contribution Guarantee, the horse being registered must meet all of the following criteria at the time of registration. By completing the registration application form the customer is representing that all of the answers provided are true and accurate and there are no material omissions.

We ask about a Horse’s Colic history during the customer’s ownership as part of the registration application process. We understand that a customer may not have full details of a horse’s history prior to their ownership, but the customer must answer all questions honestly and to the best of their knowledge.

       i.          Age & Health

•     the horse must be between 2 and 15 years old. Once a horse reaches 16 years old, it will no longer be eligible and able to benefit from the Contribution Guarantee.

•     the horse must be in sound health and free from any injury, illness, or physical abnormality at the time of registration.

•     the horse must be free of Colic and not displaying any Colic symptoms at the time of registration.

      ii.          Medical History

•     the horse must not have had any incident of Colic requiring veterinary attention in the 24 months preceding either the date the Subscription was purchased or the date of completion of the registration application form for that horse (whichever is the later date) *.

•     the horse must never have undergone Emergency Colic Surgery at any point in its life.

•     the horse must never have undergone a digestive tract resection at any point in its life.

     iii.          Eligible Product consumption

•     the horse must be consuming the Eligible Products as directed in the instructions.

 

*If the horse has received veterinary attention for Colic in the last 24 months preceding the date of the Subscription or date of the registration application (if later) the customer must provide the additional information requested during registration. Each application will be reviewed on a case-by-case basis.

    iv.          Location & Usage

•     the horse must reside within the United Kingdom.

•     Short trips, up to 30 days, to Austria, Belgium, Denmark, Finland, France, Germany, Gibraltar, Greece, Italy, Ireland Liechtenstein, Luxembourg, Monaco, Netherlands, Norway, Portugal, Spain, Sweden, Switzerland, United Kingdom will not affect eligibility.

•     The customer must notify us within 14 days of any changes to the registered horse’s health, location, or use. We can be contacted as follows: [vet@equine-america.co.uk]

5. What is Covered

Subject to these Terms and Conditions, if a registered horse requires Emergency Colic Surgery during the Subscription Period, Equine America will contribute up to £5,000 (five thousand pounds) towards reasonable and customary veterinary fees incurred in respect of:

•     Emergency Colic Surgery performed upon a Horse by a veterinary surgeon with a currently valid licence, issued by the appropriate governing agency, allowing them to practice veterinary medicine (“Veterinary Surgeon”), which has been (i) certified by the Veterinary Surgeon to have been necessitated solely by Colic; and (ii) to have been carried out in an emergency attempt to save the life of the Horse; and

•     After care costs while the Horse is kept at the veterinary hospital where the Emergency Colic Surgery was performed but limited to no more than 15 (fifteen) days from the date of the first Emergency Colic Surgery after diagnosis of Colic (“After Care”).

We consider reasonable and customary veterinary fees to be fees that are within the range of the usual fees for the same or similar service or product charged by most veterinary surgeons within the community where the service or product is supplied and justified by all the attending circumstances, including (but not limited to), the time required to perform the service or procedure, the severity of the condition treated and the complexity of treatment of a particular case.

Eligible surgery costs are covered up to the point of death, even if the horse does not survive the procedure.

6. What is Not Covered

Notwithstanding anything in these Terms and Conditions, the following are not covered under the Contribution Guarantee:

•     Any horse under 2 years old or 16 years old or older at the time of registration.

•     A horse that has previously undergone Emergency Colic Surgery, at any time in its life.

•     A horse that has undergone a digestive tract resection, at any time in its life.

•     Any horse that has received veterinary attention as a result of Colic in the last 24 months (unless accepted by us in writing following registration).

•     Non-surgical Colic treatment, including but not limited to administration of pain relief injections or mineral oils.

•     Veterinary Surgeon trip or call charges, diagnostic tests such as examinations, palpations or x-rays.

•     Any malicious or wilful injury or criminal or intentional acts or omissions by you or any third party.

•     Any transportation of a Horse to or from the veterinary hospital or Veterinary Surgeon.

•     Any post-mortem costs.

•     Any surgical operation unless an Emergency Colic Surgery performed upon a Horse by a Veterinary Surgeon, certified by them to have been necessitated solely by Colic and to have been carried out in an emergency attempt to save the life of the Horse.

•     Any Emergency Colic Surgery resulting from Colic symptoms present prior to the Subscription Period.

•     Any claim arising where your Subscription has lapsed or been cancelled for any reason.

7. Registering Your Horse

Registration of a Horse is mandatory to benefit from the Contribution Guarantee and must be completed in full before checkout of a Subscription. All fields marked with an * are required.

Existing insurance

Do you have existing insurance for your horse?

•     Yes → Please note that any existing insurance you have in place covering Emergency Colic Surgery must be exhausted in the first instance. The Contribution Guarantee will then cover any eligible costs, up to a maximum of £5,000 (five thousand pounds), for Emergency Colic Surgery.

•     No → Continue as normal.

 

You will also be required to:

•     Complete the Horse Eligibility Questionnaire and confirm all answers are correct.

•     Tick to confirm you have read and agree to the full Contribution Guarantee Terms and Conditions.

•     Enter your vet code and complete checkout.

•     Once registration and checkout are complete, we will process the application to benefit from our Contribution Guarantee and notify whether the application is successful or not. If successful, the customer will receive a confirmation email.

8. Qualifying Period

The Contribution Guarantee only becomes active 30 days after a customer’s registration has been completed and their subscription is confirmed. No contribution will be made for any Emergency Colic Surgery costs and fees that takes place within this 30-day qualifying period.

9. Keeping the Contribution Guarantee Active

To remain enrolled in the Contribution Guarantee, a customer must:

•     Maintain an active, uninterrupted Subscription to an Eligible Product.

•     Notify Equine America at vet@equine-america.co.uk within 14 days of any changes to a Horse’s health, location, or use.

•     Respond to our annual renewal reminder and confirm each Horse’s details and that the Horse’s health status is unchanged.

 

If a customer’s Subscription lapses or is cancelled for any reason, that customer’s horse (registered with the Subscription) will no longer be covered under the Contribution Guarantee with immediate effect. Cover cannot be reinstated for the same horse without a new Subscription and registration and a new 30-day qualifying period.

10. How to Make a Claim

If a registered horse requires Emergency Colic Surgery, please follow these steps:

 

1.   Contact Equine America as soon as practically possible

Email vet@equine-america.co.uk or call us without delay, and in any event within 24 hours. Please provide your registration details and a summary of what has happened.

2.   Submit your claim within 30 days of the Emergency Colic Surgery

We need to receive your claim within 30 days. If you fail to do so, we reserve the right to refuse to process your claim further.

3.   Provide the following documents

•     A completed claim form (available from Equine America [please insert link]).

•     A signed report from the operating Veterinary Surgeon describing the condition and surgical procedures performed.

•     Written confirmation from the Veterinary Surgeon that the Horse had not required veterinary attention for Colic in the last 24 months.

•     Copies of all itemised invoices for Emergency Colic Surgery and After Care costs.

•     Any other relevant documentation we request.

 

We may contact your Veterinary Surgeon or veterinary practice directly to verify the claim. You agree to co‑operate fully with any reasonable requests for information and to ensure that your Veterinary Surgeon is authorised to communicate directly with us. Where necessary, you agree to sign any additional consent forms reasonably required to enable disclosure of veterinary information. By registering for the Contribution Guarantee, you authorise your veterinary practice to release records relevant to any Emergency Colic Surgery claim to Equine America or its appointed claim administrators.

Failure to comply with any of your obligations when making a claim may result in your claim being rejected by us.

11. Annual Renewal

We will send you an annual renewal reminder asking you to confirm that:

•     Your Subscription remains active.

•     Your Horse’s details, health status, and veterinary practice information are unchanged.

 

You are responsible for providing accurate information at renewal. If you do not respond or provide incorrect information, your Contribution Guarantee may be invalidated.

12. Cancellation

Customer’s right to cancel

A customer may cancel a Subscription at any time by sending us written notice to this effect at vet@equine-america.co.uk. The cancellation will take effect immediately from receipt of your notification. Cancelling a Subscription will mean that the horse registered with that Subscription is no longer able to benefit from the Contribution Guarantee, effective from the date of cancellation. The Contribution Guarantee will still apply to a valid claim made prior to the cancellation of that Subscription.

Our right to cancel

We reserve the right to remove a horse from the Contribution Guarantee if:

•     Information provided at registration is found to be inaccurate or incomplete.

•     The customer’s Subscription for that registered horse lapses or is cancelled.

•     There is a change in the horse’s circumstances that affects eligibility under the Contribution Guarantee.

 

We will notify the customer of any changes to their Contribution Guarantee status as soon as possible.

13. Customer’s Responsibilities

By registering for the Contribution Guarantee, a customer confirms that:

•     All information provided is true, accurate, and complete to the best of the customer’s knowledge.

•     The customer will tell us without delay and in any event within 14 days of becoming aware of any changes in the information provided to us which happens before or during any Subscription Period. If a customer becomes aware that information provided is inaccurate, they must inform us as soon as practicably possible and in any event within 7 days of becoming aware.

•     That they understand that providing false or misleading information may invalidate the Contribution Guarantee for the registered horse and result in a claim being rejected.

•     They are the owner of the Horse or have the legal right to register on their behalf.

14. Data and Privacy

To administer the Contribution Guarantee and validate any claims, we may need to share a customer’s personal data and their horse’s information with trusted third-party partners, including our insurance partner. These partners are contractually obligated to keep customer data secure and to use it only for the purpose of administering the Contribution Guarantee.

To process a claim, we may need to request relevant veterinary records from a customer’s veterinary practice. By registering for the Contribution Guarantee, a customer authorises their veterinary practice to release records relevant to any Emergency Colic Surgery claim to Equine America or its appointed claim administrators.

We will handle all personal data in accordance with applicable data protection laws. Our full Privacy Policy is available at www.equine-america-vet.co.uk.

15. General

•     These Terms and Conditions are governed by the law of England and Wales.

•     The Contribution Guarantee is a product benefit, not a standalone insurance product.

•     Equine America reserves the right to amend these terms, at its sole discretion. We will give you reasonable notice of any changes.

•     Equine America may withdraw the Contribution Guarantee at any time, at its sole discretion.

•     These terms do not affect your statutory rights as a consumer.
